A Specific Agreement with Your Specific Rental Requests and Requirements Will Be Coordinated Between You and Our Local Property Manager At The Time Of Your Reservation.
Also For Your Information, Our Standard Policies Include the Following Summary of General Expectations To Support Your Pre-Planning and Reservations:
Reservations are requested to be completed more than 60 Days in advance or by special agreement. As the Lake City area has large Spring, Summer and Fall seasonal demands for lodging, you are advised to make reservations at least 4 to 6 months early for holiday times and to ensure space availability for your upcoming visit.
A Reservation/Cleaning/Damage Deposit is required to be paid in advance to confirm a reservation.
The Reservation/Cleaning/Damage Deposit is held separate from all Rental Fees and is Fully Refundable following full completion of the rental period, if the property is returned in the original condition (Clean and No Damage). The amount of the deposit varies by unit size and is shown in our Rental Descriptions on the preceeding Web Page. The Deposit should be mailed to and confirmed with us or our Local Property Manager when space availability for your reservation has been confirmed.
Total Amount of Each Vacation Rental is Due At Least 30 Days in Advance of Arrival Date, and is payable by Money Order, Cashiers Check or Visa or MasterCard Credit Card.
Deposits are held seperate from the Rental Payment and there are No Refunds of Deposits if Reservations are Cancelled Within 30 Days of Rental Dates, Unless Another Replacement Rental Can Be Booked.
All Guests are Required to Carry Their Own Personal and Property Insurances and To Sign a Liability Waiver.
No Smoking or Fires of Any Kind Please without prior written consent of the Property Manager and Property Owners.
No Pets or Undocumented Occupants Allowed without prior written consent of the Property Manager and Property Owners.
A 9.8% Colorado State and Hinsdale County Local Tax must be added to the total of each Rental fee. This tax is not applicable to the refundable Deposit.

THE FOLLOWING IS THE RENTAL AGREEMENT AND THE TENANTS FULL ACCEPTANCE OF PERSONAL LIABILITY MADE BETWEEN THE TENANT(S) (____________________________) and SUNSHINE FALLS VACATION HOME PROPERTY MANAGER.
1. RENTAL TERM AND TERMINATION RENTAL TERM FOR THIS UNIT IS STRICTLY LIMITED TO THE FOLLOWING DATES: _____ ____. THE OWNER OR PROPERTY MANAGER MAY IMMEDIATELY TERMINATE THIS AGREEMENT, VERBALLY OR IN WRITING, SHOULD THE TENANT(S), OCCUPANTS OR GUESTS VIOLATE ANY PROVISION CONTAINED HEREIN, IN ANY DEGREE. SHOULD THIS AGREEMENT BE TERMINATED, THE TENANT(S) AGREES TO ALL OR PARTIAL FORFEITURE OF DEPOSITS AND PAYMENTS MADE, AND TO BE HELD LIABLE FOR ANY DAMAGES RESULTING FROM THEIR ACTIONS. IN ADDITION, UPON TERMINATION OF THIS AGREEMENT, THE TENANT(S) AGREES TO IMMEDIATELY RETURN THE PREMISES, TO THE OWNER OR PROPERTY MANAGER, IN COMPLETE ORIGINAL, MOVE-IN CONDITION AND THEN VACATE THE PROPERTY. SHOULD THE PROPERTY NOT BE RETURNED TO THE OWNER OR PROPERTY MANAGER IN THIS CONDITION, A $25/HR CHARGE TO CLEAN THE UNIT PLUS THE COSTS OF ANY REPAIRS WILL BE ASSESSED THE TENANT(S).
2. TENANTS FULLY UNDERSTAND THAT DANGEROUS CONDITIONS EXIST
THE TENANT(S) AND THEIR GUESTS HAVE BEEN ADVISED BY THE OWNER AND PROPERTY MANAGER, THAT THE STEEP MOUNTAINS, ROCKY CLIFFS, ROCK SLIDE AREAS, LAKES, PONDS, AVALANCHE AND FLASH FLOOD ZONES, FORESTS, ROADS, RIVERS, EXCAVATIONS, MINES (AND OTHER MAN-MADE HAZARDS) THAT EXIST IN AND AROUND THE SUNSHINE FALLS PROPERTY ARE INHERENTLY DANGEROUS, DUE TO NUMEROUS OBSTRUCTIONS, UNCERTAIN AND UNSTABLE CONDITIONS, AND UNFORESEEN CIRCUMSTANCES. THE TENANT(S) AND THEIR GUESTS ARE FULLY AWARE OF THE DANGERS, FULLY UNDERSTAND THE NEED TO BE VERY CAREFUL AND ALERT TO SAFETY CONSIDERATIONS AT ALL TIMES, AND ACCEPT COMPLETE PERSONAL AND GROUP RESPONSIBILITY FOR SAFETY WHEN IN AND AROUND THE SUNSHINE FALLS PROPERTY.
3. TENANTS HOLD THE OWNER AND MANAGEMENT HARMLESS OF ANY LIABILITY
FURTHER, ALL TENANT(S), INCLUDING OTHER OCCUPANTS AND GUESTS, UNDERSTAND AND AGREE THAT THEY ARE SOLELY, INDIVIDUALLY AND COMPLETELY RESPONSIBLE FOR THEIR OWN SAFETY. FURTHERMORE, ALL TENANT(S) ALSO AGREE TO HOLD THE OWNER AND PROPERTY MANAGER HARMLESS OF ANY LIABILITY FOR ANY ACCIDENT OR ANY INJURY THAT MAY OCCUR TO ANYONE OR ANYTHING DURING THEIR STAY.
4. LIMIT ON NUMBER OF TENANTS (INCLUDING OCCUPANTS AND OTHER GUESTS
THE TENANTS AND PROPERTY MANAGER HAVE AGREED UPON A LIMITED NUMBER OF OCCUPANTS (ADULTS AND CHILDREN) FOR THE SUNSHINE FALLS VACATION HOME UNIT(S) DESCRIBED BY PARAGRAPH 11. (RENTAL INFORMATION, DEPOSIT, AND RENT DUE) IN THIS AGREEMENT. THE TENANT(S) AGREE THAT THERE ARE TO BE NO MORE THAN THE AGREED NUMBER STAYING ON SAID PREMISES - NO EXCEPTIONS - SUBJECT TO IMMEDIATE TERMINATION OF THIS AGREEMENT AT SOLE DISCRETION OF THE PROPERTY MANAGER AND OWNER.
5. NO SMOKING AND NO FIRES ALLOWED DUE TO THE EXTREME RISK OF FIRE DANGER IN THE COLORADO MOUNTAINS, TENANT(S) AND THEIR GUESTS UNDERSTAND THAT THERE IS NO SMOKING IN THE SUNSHINE FALLS HOUSE OR IN OR AROUND THE PROPERTY BOUNDARIES. ABSOLUTELY NO FIRES OF ANY KIND (CAMPFIRES, TRASH FIRES BONFIRES, ETC.) ARE PERMITTED ON, NEAR OR AROUND THE PREMISES WITHOUT PRIOR WRITTEN APPROVAL OF THE PROPERTY MANAGER AND PROPERTY OWNERS. THERE ARE NO EXCEPTIONS AND VIOLATION OF THIS REQUIREMENT IS GROUNDS FOR IMMEDIATE TERMINATION OF THIS AGREEMENT. 6. NO PETS OR ANIMALS ALLOWED AND NO HUNTING OR FIREARMS ALLOWED
THE TENANT(S) UNDERSTAND AND AGREE THAT NO PETS AND NO DOMESTIC ANIMALS OF ANY KIND ARE ALLOWED IN THE HOUSE OR IN OR AROUND THE PROPERTY. THERE IS NO HUNTING AND NO FIREARMS ALLOWED IN OR AROUND THE SUNSHINE FALLS PROPERTY.
7. LIMITED USE OF MOTORIZED VEHICLES ON PROPERTY THE USE OF ANY MOTOR VEHICLES (CARS, TRUCKS, MOTORCYCLES, ATVs, ETC.) IS RESTRICTED TO THE PRIMARY DRIVEWAY FROM COUNTY ROAD 30 TO THE MAIN RESIDENCE. ANY ADDITIONAL USE OF MOTORIZED VEHICLES ON THE SUNSHINE FALLS PROPERTY, INCLUDING ON THE 4 WHEEL DRIVE ROAD TO THE WATERFALL, IS STRICTLY PROHIBITED WITHOUT THE PRIOR WRITTEN APPROVAL OF THE PROPERTY MANAGER AND PROPERTY OWNER.
8. NON-INTERFERANCE AND RESPECT FOR THE RIGHTS OF OTHER TENANT(S)/GUESTS
AS THERE MAY BE OTHER GUESTS OR THE OWNERS IN RESIDENCE AT THE SUNSHINE FALLS HOUSE, THE TENANT(S) AGREE THAT THEY WILL NOT INTERFERE IN ANY WAY WITH ANY OF THE OTHER GUESTS AND THAT THEY WILL RESPECT THE RIGHTS OF OTHERS WHICH SHALL INCLUDE, BUT NOT LIMITED TO: PARKING, NOISE, PERSONAL SPACE , DISTURBANCE AND INTERRUPTIONS, GARBAGE AND LITTER, PERSONAL SAFETY, AND PROPERTY PROTECTION. TENANT(S) FURTHER AGREE THAT THEY WILL BE HELD ACCOUNTABLE FOR ANY DAMAGES THEY AND THEIR GUESTS MAY INFLICT.
9. RESERVATION/CLEANING/DAMAGE DEPOSIT
A RESERVATION/CLEANING/DAMAGE DEPOSIT, THAT IS SEPARATE FROM ALL RENTAL FEES, WILL BE HELD FOR BOTH THE RESERVATION AND TO ASSURE THAT HOUSE IS LEFT IN MANNER FOUND (CLEAN AND NO DAMAGE TO REAL OR PERSONAL PROPERTY) AND IS FULLY REFUNDABLE IF THIS IS MET. DEPOSITS ARE NON-REFUNDABLE IF RESERVATIONS ARE CANCELLED LESS THAN 30 DAYS IN ADVANCE OF ARRIVAL DATE AND ONLY IF THE UNIT VACANCY CANNOT BE FILLED (COMMUNICATION AND ADVANCE NOTICE IS HIGHLY RECOMMENDED). CLEANING/DAMAGE DEPOSIT IS SEPARATE FROM RENT AND WILL NOT COUNT TOWARDS AMOUNT DUE. IF PROPERTY IS NOT RETURNED IN ORIGINAL MOVE-IN CONDITION, CLEANING COSTS SHALL BE ASSESSED AT THE RATE OF $25/HR, AND REPAIRS WILL BE CHARGED BASED ON THE COSTS FOR LABOR AND MATERIALS. TRASH BAGS ARE PROVIDED IN ALL UNITS AND TRASH SHOULD BE BAGGED AND TIED, AND LEFT OUTSIDE THE SHED, UPON DEPARTURE.
10. PROTECTION OF REAL AND PERSONAL PROPERTY THIS HOME IS FULLY-FURNISHED AND FULLY-DECORATED WITH PERSONAL PROPERTY OF THE OWNER AND THE UNITS COME SUPPLIED WITH COOKING UTENSILS, TOWELS, SHEETS, BLANKETS (EVERYTHING NECESSARY), TV/VCR/SATELLITE TV (TV/VCR ARE AVAILABLE IN ALL UNITS AND SATELLITE TV MAY BE AVAILABLE – NO PAY-PER-VIEW), AND PARTY-LINE PHONE (PHONES MAY BE SHARED FOR MULTIPLE UNITS - LOCAL AND CREDIT CARD CALLS ONLY!). TENANT(S)UNDERSTANDS THAT IT IS THEIR RESPONSIBILITY TO KEEP ENTIRE EXTERIOR PREMISES FREE AND CLEAR FROM ALL GARBAGE AND LITTER. THE TENANT(S) UNDERSTAND THAT THEY ARE REQUIRED TO PRESERVE AND PROTECT ALL REAL PROPERTY, ALL PERSONAL PROPERTY OF THE OWNERS, AND ALL ARTICLES PROVIDED OR STORED ANYWHERE IN THEIR DESIGNATED UNIT OR ON THE PREMISES, AND IT IS UNDERSTOOD THAT DEDUCTIONS FROM THE RESERVATION/CLEANING/DAMAGE DEPOSIT WILL BE ENFORCED IN ACCORDANCE WITH COLORADO LAW.
